Welcome to CryptoKars (the "Platform"), operated by Crypto Marketplace ("we," "us," or "our"). By accessing or using the Platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1. Acceptance of Terms
By creating an account or using any part of the Platform, you accept and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. Peer-to-peer marketplace
CryptoKars is a connection tool only. We do not handle, escrow, process, or guarantee any transactions. All negotiations, payments, and title transfers are solely between users. We are not responsible for deals, fraud, vehicle condition, crypto volatility, or title/registration obligations. Use the Platform at your own risk.
3. Accounts
You must provide accurate, current information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Subscription plans and pricing
The Platform offers subscription plans that govern listing and photo limits. Subscriptions are for CryptoKars and billed through Stripe. Current fees for paid plans are shown at Stripe Checkout, on our public Pricing page, and on the signed-in Plans & billing page; they may change with notice as described in Billing below.
Subscriptions: operator & product
Operator. Crypto Marketplace operates CryptoKars. What you are buying. Paid plans are software subscriptions that raise your listing and publishing limits on the Platform—they are not a vehicle, escrow, or transaction service. Customer service. 4.2 New user default. All new users start on the Free plan. No credit card is required for Free accounts.
4.3 Annual plans. Where offered, annual billing may provide a discount compared to twelve months of monthly billing; the exact savings depend on the prices shown at checkout.
4.4 Promotional offers. From time to time we may offer time-limited discounts, credits, or other promotions on subscriptions. Any promotion is subject to its stated terms (including eligibility, duration, and stacking rules). Unless we say otherwise in writing for that promotion, promotional pricing applies only to the initial term or period described in the offer and does not guarantee future pricing. We may decline or revoke a promotion if we reasonably believe it is being abused or used in violation of the offer terms.
5. Billing and payments
- 5.1 Recurring billing. Subscriptions are billed on a recurring basis (monthly or annually) via Stripe. By subscribing, you authorize us to charge the payment method on file at the start of each billing period.
- 5.2 Auto-renewal. Subscriptions automatically renew until you cancel. You will be charged the then-current price unless you cancel before the renewal date.
- 5.3 Cancellation. You may cancel through the Stripe Customer Portal, accessible from your account (e.g. Plans & billing). Cancellation is effective at the end of the current billing period; you retain paid features until then, after which your account reverts to the Free plan and its limits.
- 5.4 No refunds. We do not provide refunds for partial billing periods. If you cancel mid-cycle, your subscription remains active until the period ends.
- 5.5 Price changes. We may change subscription pricing with at least 30 days' prior notice by email or in-app notification. Continued use after the change constitutes acceptance.
- 5.6 Payment disputes and chargebacks. If you have a billing question or believe a charge is incorrect, contact us first at hello@cryptokars.com or hello@cryptokars.com so we can review your account. If you initiate a chargeback or payment dispute with your bank or card network, we may suspend or terminate access pending resolution, as permitted by law and by the rules of the payment method.
6. Listing limits and fair usage
- 6.1 Enforcement. Limits are enforced in real time; attempts to exceed them may be denied with an error.
- 6.2 Draft limits. Only active drafts (status draft, not deleted) count toward your draft limit.
- 6.3 Monthly publish quota. The quota resets on the 1st of each calendar month (UTC). Publishing is counted when a listing is submitted for moderation.
- 6.4 Photo limits. Photo limits apply per listing across all image statuses (pending, approved, rejected).
- 6.5 Circumvention. Attempts to circumvent limits (including multiple accounts, automated abuse, or exploiting bugs) may result in suspension or termination.
7. User content and photos
You retain ownership of content you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute your content on the Platform.
By uploading photos, you grant Crypto Marketplace a free, perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, display, distribute, and share those photos on the Platform and for promotional and marketing purposes on and off the Platform, including but not limited to: social and professional networks; short-form and long-form video platforms; email, SMS, and in-app or push messaging (where permitted); paid, owned, and earned digital advertising (such as search, display, and sponsored placements); podcasts, streaming audio, and broadcast or cable media; print, out-of-home, and event or trade-show materials; press releases, case studies, and investor or partner communications; co-marketing with affiliates, influencers, or sponsors; and any other media or format now known or hereafter developed, without additional compensation or further permission.
Reservation of rights. Without limiting the foregoing, we reserve the right to share and redistribute your ad listings and photos—including listing text, pricing, location, and images—on the Platform, in communications about the Platform, and for marketing, partnerships, or other promotional purposes on other mediums, including but not limited to the channels and use cases described above, and any similar or successor services, subject to applicable law and this Privacy Policy.
8. Prohibited conduct
You agree not to:
- Post fraudulent, misleading, or illegal listings, or content that infringes others' rights.
- Circumvent subscription or listing limits.
- Interfere with the Platform's infrastructure.
- Violate applicable law or regulation.
You must be at least 18 years old. You are responsible for complying with laws governing vehicle sales, title transfers, and cryptocurrency. We may remove content and suspend or terminate accounts for violations.
9. Termination
We may suspend or terminate your account at our discretion for violations of these Terms or for other reasons, with or without notice.
10. Disclaimer of warranties
The Platform is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not verify listings, users, or the accuracy of content.
11. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.
12. Indemnification
You agree to indemnify and hold harmless Crypto Marketplace and its operators from claims, losses, or damages arising from your use of the Platform or your dealings with other users.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
